These Terms of Service ("Terms") govern your use of the CatPod mobile application, connected devices, and related services (collectively, the "Service") operated by CATPOD, TOO, a limited liability partnership registered in the Republic of Kazakhstan ("we," "us," or "our").

Please read this section carefully before using CatPod.CatPod is a wellness monitoring tool. It is not a veterinary service, and it does not provide veterinary medical advice, diagnosis, or treatment.

  • The health insights, alerts, trend analyses, and recommendations provided through the Service are informational only and are generated using artificial intelligence and sensor data. They are not a substitute for professional veterinary care.
  • CatPod does not diagnose, treat, cure, or prevent any disease, illness, or medical condition in animals.
  • AI-generated health assessments, wellness scores, and chatbot responses are probabilistic estimates, not clinical determinations. They may be inaccurate, incomplete, or misleading.
  • Always consult a qualified, licensed veterinarian for medical decisions regarding your pet's health. Do not delay seeking veterinary care based on information provided by the Service.
  • CATPOD, TOO is not liable for any health outcomes, injury, illness, or death of any animal resulting from actions taken or not taken based on information provided by the Service, including but not limited to AI-generated insights, device sensor readings, health alerts, or chatbot responses.

If you believe your pet is experiencing a medical emergency, contact your veterinarian or an emergency animal hospital immediately.



2. Acceptance of Terms

By creating an account, downloading the app, connecting a device, or otherwise accessing the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.These Terms constitute a legally binding agreement between you and CATPOD, TOO. We may offer additional features or services subject to supplemental terms, which will be presented to you at the time of use.



3. Service Description

CatPod is a connected home wellness ecosystem for household cats. The Service includes:

  • Connected devices (such as CatPad and CatPen) equipped with sensors that collect health and environmental data about your cat
  • AI-powered health monitoring, including weight tracking, vital sign trends, activity patterns, and wellness scoring
  • An AI wellness assistant (chatbot) that provides informational responses about cat health and care
  • Health alerts and notifications based on sensor data analysis
  • Optional veterinary consultation facilitation — we may help you connect with third-party veterinary professionals, but we do not provide veterinary services ourselves
  • Health reports that you may choose to share with your veterinarian

The Service is under active development. Features may be added, modified, suspended, or removed at any time. We will make reasonable efforts to notify you of significant changes, but the availability of any specific feature is not guaranteed.



4. Account Registration

To use the Service, you must create an account. By registering, you represent that:

  • You are at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater
  • The information you provide during registration is accurate, current, and complete
  • You will maintain and promptly update your account information as needed

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.Each CatPod device is designed to be paired with one cat profile. Accurate pet profile information (breed, age, weight) is important for the Service to function properly.



5. Subscription and Payment

5.1 Free and Premium Tiers

CatPod offers a free tier with limited features and a Premium subscription with expanded capabilities. Details of what is included in each tier are described within the app.Health and safety alerts are always available regardless of your subscription status. Critical and warning-level health alerts are never gated behind a paid subscription. If your device detects a significant health concern, you will be notified whether or not you are a Premium subscriber.

5.2 Premium Pricing

Current subscription pricing is displayed within the app and may vary by region and payment method. Pricing is subject to change in accordance with Section 5.5 below.

5.3 Auto-Renewal

Premium subscriptions renew automatically at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You authorize us to charge your selected payment method for each renewal period.

5.4 Cancellation and Refunds

You may cancel your Premium subscription at any time through the app or your app store account settings. Upon cancellation:

  • You retain access to Premium features until the end of your current paid billing period
  • No prorated refunds are issued for the remaining portion of a billing period
  • After the billing period ends, your account reverts to the free tier

5.5 Price Changes

We may adjust subscription pricing from time to time. If we change the price of your subscription, we will notify you via the app and/or email before your next billing cycle. Continued use of the Premium subscription after a price change takes effect constitutes acceptance of the new price.

5.6 Payment Processing

Payments are processed by third-party payment processors. We do not directly store or handle your payment card details. Your use of any third-party payment service is subject to that provider's own terms and privacy practices.

5.7 Hardware Bundles

CatPod hardware bundles may include connected devices and a period of Premium subscription as described at the time of purchase. After any included Premium period expires, continued Premium access requires a separate subscription. Bundle pricing and contents are displayed at the point of sale.



6. CatPod Devices

6.1 General

CatPod devices (including CatPad and CatPen) are designed to work in conjunction with the CatPod app. Devices require an active internet connection and a compatible mobile device to transmit data and receive updates.

6.2 Your Responsibilities

You are responsible for:

  • Properly setting up, positioning, and maintaining your devices according to the provided instructions
  • Handling devices with care — they contain precision sensors and electronics
  • Keeping devices updated with the latest firmware delivered through the app
  • Using devices only for their intended purpose

6.3 Limitations

Sensor readings may be affected by environmental conditions, device placement, pet behavior, and other factors. We do not guarantee the accuracy or completeness of any data collected by the devices.We are not liable for device malfunction, inaccurate readings resulting from improper use or setup, damage caused by misuse, or any consequences arising from reliance on device data.

6.4 Firmware Updates

We may periodically release firmware updates for CatPod devices through the app. These updates may include bug fixes, performance improvements, and new features. We strongly recommend keeping your devices updated. Certain features of the Service may require a minimum firmware version to function properly.



7. User Content and Data

7.1 Ownership

You retain ownership of the data you provide to the Service, including pet profiles, photographs, chat messages, and any other content you submit ("User Content").

7.2 License to Process

By using the Service, you grant CATPOD, TOO a non-exclusive, worldwide, royalty-free license to process, analyze, store, and use your User Content solely for the purposes of providing and improving the Service. This includes processing data through artificial intelligence systems to generate health insights, alerts, and recommendations.

7.3 How Your Data Is Processed

  • Chat messages are processed by AI systems to extract health-relevant information. Extracted health facts are stored as part of your pet's health profile. Full chat conversation history is not permanently retained.
  • Device data (weight, temperature, pulse, activity) is collected, stored, and analyzed to provide health monitoring and trend tracking.
  • Images captured through CatPen or uploaded by you are processed for health analysis purposes and stored securely.

7.4 Data Sharing with Veterinary Professionals

You control whether your pet's health data is shared with veterinary professionals. Sharing requires your explicit consent each time. Health reports generated for vet consultations are reviewed by you before they are sent to any third party.For details on how we collect, store, and protect your personal data, please refer to our Privacy Policy.



8. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the app, firmware, or any component of the Service
  • Tamper with, modify, or interfere with the operation of CatPod devices or the Service
  • Use the Service for any unlawful, harmful, or fraudulent purpose
  • Attempt to access another user's account, data, or pet profiles without authorization
  • Misrepresent the outputs of the Service (including AI-generated insights, health scores, or chatbot responses) as professional veterinary advice or clinical diagnoses
  • Use bots, scrapers, automated scripts, or other automated means to access or interact with the Service
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Upload or transmit viruses, malware, or any other harmful code

We reserve the right to suspend or terminate your access to the Service if we reasonably believe you have violated these terms.



9. Intellectual Property

The CatPod app, its content, design, features, algorithms, firmware, documentation, and branding are the property of CATPOD, TOO and are protected by applicable intellectual property laws."CatPod," "CatPad," and "CatPen" are trademarks of CATPOD, TOO.Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app on your personal devices for your personal, non-commercial use. This license does not include any right to:

  • Copy, modify, or create derivative works based on the app or its content
  • Distribute, publicly display, or publicly perform any part of the Service
  • Sublicense or transfer your rights under this license to any third party


10. Third-Party Services

The Service may integrate with or provide access to third-party services, including:

  • Veterinary consultation platforms — we facilitate connections to third-party veterinary professionals and platforms but do not provide veterinary services ourselves
  • Payment processors — subscription and purchase payments are handled by third-party providers
  • Cloud infrastructure and AI services — the Service relies on third-party technology providers for hosting, data processing, and AI capabilities

We are not responsible for the availability, accuracy, content, terms of service, or privacy practices of any third-party service. Links to or integrations with third-party services do not constitute an endorsement by CATPOD, TOO. Your use of any third-party service is at your own risk and subject to that service's terms.



11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CATPOD, TOO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, error-free, or available at all times
  • Health insights, alerts, wellness scores, or any AI-generated content will be accurate, complete, reliable, or timely
  • Sensor data from CatPod devices will be free from error or variation caused by environmental conditions, device placement, or pet behavior
  • The Service will detect any or all health conditions or changes in your pet's health

AI-generated insights are probabilistic in nature and should be treated as informational guidance, not as definitive assessments.



12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CATPOD, TOO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any health outcomes, injury, illness, deterioration, or death of any animal, whether or not related to information provided by the Service
  • Any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service
  • Any loss of data, although we take reasonable precautions to protect data integrity
  • Any actions taken or not taken by you based on information, alerts, insights, or recommendations provided by the Service
  • Any failure or delay in the Service caused by factors beyond our reasonable control

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF CATPOD, TOO FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.



13. Termination

13.1 By You

You may delete your account at any time through the app settings. Upon account deletion:

  • Your active subscription will end (no refund for the remaining billing period)
  • Your personal data and pet data will be deleted in accordance with our Privacy Policy
  • CatPod devices will continue to function in basic offline mode (such as CatPad heating), but app-dependent features will no longer be available

13.2 By Us

We may suspend or terminate your account if:

  • You materially breach these Terms
  • Your use of the Service poses a risk to other users or to the operation of the Service
  • We are required to do so by law

Where possible, we will provide you with notice and an opportunity to address the issue before termination. In cases of severe violations or legal requirements, we may act immediately.Upon termination by us, the same consequences described in Section 13.1 apply.



14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions.In the event of any dispute arising from or relating to these Terms or the Service, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may bring the dispute before the courts of competent jurisdiction in Almaty, Republic of Kazakhstan.



15. Changes to Terms

We may update these Terms from time to time to reflect changes in the Service, legal requirements, or our business practices.If we make material changes, we will notify you at least thirty (30) days before the changes take effect, through a notice in the app and/or an email to the address associated with your account.Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the revised Terms, you may terminate your account before the changes become effective.



16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions of these Terms shall continue in full force and effect.
